These Terms of Service (the “Terms”) govern your access to and use of velurahair.ca (the “Site”) and any products you purchase from us. The Site is operated by Velura Hair (“Velura,” “we,” “us,” or “our”), based in Richmond Hill, Ontario, Canada.

By browsing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

We currently sell and ship within Canada only. At launch, orders to Quebec are not accepted. If your shipping address is in Quebec, checkout will be blocked. We will update these Terms when we begin serving Quebec.

2. Eligibility

To place an order, you must:

be at least the age of majority in your province of residence (18 in Ontario, 19 in some provinces);
have a valid shipping address in Canada outside Quebec;
have legal capacity to enter into a binding contract;
provide accurate, current, and complete information during checkout.

The Site is not directed to children. If you are under the age of majority, do not submit personal information or attempt to purchase from us.

3. Accounts

You may check out as a guest or create an account through Shopify at checkout. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use.

We may suspend or terminate accounts that we reasonably believe are being used for fraud, abuse, or any violation of these Terms.

4. Products and pricing

Velura currently sells one product: the Velura Elixir, a small-batch hair and scalp oil in a 4 fl oz (118 mL) amber glass dropper bottle.

All prices are listed in Canadian dollars (CAD) and exclude applicable taxes (GST/HST/PST), which are calculated at checkout based on your shipping province.
Promotional pricing is offered for a limited time and may change without notice.
We reserve the right to correct pricing or product information errors at any time, including after an order is placed. If we do so before your order ships, we will notify you and offer the option to confirm the corrected order or cancel for a full refund.
Product photographs are illustrative. Bottle colour, label finish, and presentation may vary slightly between batches.
Stock is limited and small-batch. Listed availability is not a guarantee, and we may cancel and refund any order we are unable to fulfill.

Claims such as “natural,” “cruelty-free,” and “vegan-friendly” describe ingredient sourcing and formulation choices. They are not medical or therapeutic claims. See Section 12.

5. Orders and order acceptance

An order placed through the Site is an offer to purchase. Your order is accepted when we send a shipping confirmation email; until then, no contract of sale exists. We may refuse or cancel any order for reasons including, but not limited to:

the product or shipping address is outside our service area (including Quebec);
the order appears to be fraudulent, abusive, or for resale;
a pricing or inventory error;
we are unable to verify payment or shipping information.

If we cancel an accepted order, we will refund any amount already charged through the original payment method.

6. Payment

We accept payment through Shopify Payments (credit and debit cards) and PayPal. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us (and our payment processors) to charge it for the total order amount, including taxes and shipping.

Payment processing is performed by our processors under their own terms. We do not store full card numbers on our servers. See our Privacy Policy for details on how payment information is handled.

7. Shipping and delivery

We ship within Canada only, excluding Quebec. Shipping fees, available carriers, and estimated delivery windows are shown at checkout and depend on your destination.

Risk of loss passes to you when the carrier takes possession of the package. Title passes once we have received payment in full.
Delivery estimates are provided by the carrier and are not guaranteed. We are not responsible for carrier delays, weather disruptions, or events outside our reasonable control.
Incorrect or incomplete addresses may result in delivery failure. You are responsible for ensuring the shipping address is correct at checkout. Re-shipping costs for returned-to-sender packages caused by an incorrect address are your responsibility.
Lost or stolen packages reported as delivered by the carrier should be reported to us within 7 days. We will work with the carrier to investigate, but we cannot guarantee replacement of items confirmed delivered.
Customs and duties do not apply for domestic Canadian shipments.

8. Returns, refunds, and exchanges

The Elixir is covered by our 60-Day Love It Guarantee. If you are not in love with your results within 60 days of delivery, we will refund you in full — no return required.

To request a refund, contact [email protected] within 60 days of delivery and tell us you would like a refund.
We will process your refund within 5–7 business days.
Keep the Elixir — there is no need to ship it back.
One claim per customer, verified by shipping address.
Damaged or defective items: contact us immediately at [email protected]. We will send a replacement or process a refund.

This policy is in addition to, and does not limit, any non-waivable rights you have under Ontario’s Consumer Protection Act, 2002 or other applicable Canadian consumer protection legislation.

9. Subscriptions

If you select a subscription option at checkout (for example, a recurring delivery of the Elixir), the following additional terms apply:

Authorization. You authorize us to charge your payment method on the recurring schedule you selected (every 4, 6, 8, 10, or 12 weeks) at the then-current subscription price, plus applicable taxes and shipping, until you cancel.
Renewals. Subscriptions automatically renew at the end of each billing cycle. We will send a reminder email before each renewal where required by applicable law, including under Ontario’s consumer protection rules for future-performance and recurring agreements.
Cancellation. You may cancel at any time before the next billing date by managing your subscription from your account page or by emailing [email protected]. Cancellation takes effect at the end of the current billing cycle; we do not pro-rate partial periods.
Skipping or pausing. Where supported, you may skip or pause an upcoming shipment from your account page.
Price changes. We may change subscription pricing on notice. Changes apply to renewals on or after the effective date; you may cancel before that date if you do not agree.
Refunds on subscription orders. Section 8 applies to subscription shipments. Once a subscription order has shipped, that order cannot be cancelled mid-shipment, but the underlying subscription can still be cancelled to prevent future shipments.

10. Promotions, discount codes, and gift cards

Discount codes and promotions are limited to the terms stated at the time of the offer (for example, one use per customer, minimum order value, expiry date, or product exclusions).
Codes have no cash value, are non-transferable, and cannot be combined unless explicitly stated.
We may revoke or modify a promotion at any time, including where it has been distributed in error or used in a manner we reasonably believe is fraudulent.
Gift cards, if offered, are governed by their own terms displayed at the time of purchase and applicable provincial law (gift cards issued in Ontario do not expire and are not subject to dormancy fees).

11. User content and reviews

If you submit a review, comment, photo, or other content to the Site or to our reviews provider (Judge.me) (“User Content”), you represent that:

the content is your own and does not infringe anyone else’s rights;
the review reflects your honest experience with the product;
you were not paid or compensated for the review beyond, where applicable, receiving the product;
you grant Velura a non-exclusive, royalty-free, worldwide, perpetual, sublicensable licence to use, display, reproduce, modify, and distribute the User Content in connection with marketing, advertising, and operating the Site, with attribution where reasonable.

We may, in our sole discretion, decline to publish, edit for length and clarity, or remove User Content that is unlawful, defamatory, obscene, threatening, off-topic, or otherwise inappropriate. We do not endorse User Content and are not responsible for its accuracy.

12. Product use, allergies, and health disclaimer

The Velura Elixir is a topical cosmetic product intended for use on hair and scalp. It is not a drug or medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition, including hair loss.

Patch test the product on a small area of skin 24 hours before first use. Discontinue use immediately if you experience irritation, redness, itching, or any adverse reaction.
Always read the ingredient list. If you have a known allergy or sensitivity to any listed ingredient, do not use the product.
For external use only. Avoid contact with eyes. Keep out of reach of children. If swallowed, contact a poison control centre.
If you are pregnant, breastfeeding, or under medical care, consult a qualified healthcare professional before use.

Individual results vary. Testimonials and reviews reflect individual experience and are not a guarantee that you will experience the same results.

13. Intellectual property

The Site and all content on it — including the Velura name, logo, brand marks, product photography, copy, illustrations, layout, and code — are owned by Velura Hair or our licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes. You may not:

copy, modify, distribute, publicly display, or create derivative works from any part of the Site without our prior written consent;
use the Velura name, logo, or marks in a way that is likely to cause confusion, imply endorsement, or disparage us;
scrape, crawl, or use automated tools to extract data from the Site, except for legitimate search engine indexing in compliance with our robots.txt;
use the Site or our content to train machine learning models without our express written permission.

14. Prohibited uses

You agree not to use the Site to:

violate any applicable law or regulation;
infringe the intellectual property or privacy rights of others;
transmit malware, viruses, or other harmful code;
attempt to gain unauthorized access to the Site, the underlying server, or any related systems or networks;
interfere with the proper working of the Site, including by overloading, flooding, spamming, or otherwise disrupting it;
collect personal information of other users without their consent;
resell or commercially redistribute Velura products without our prior written authorization.

15. Third-party services and links

The Site relies on third-party service providers (including Shopify, Shopify Payments, PayPal, Klaviyo, Judge.me, Google, Meta, TikTok, Umami, Sentry, and shipping carriers) and may link to third-party websites. Your use of those services and sites is governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services or sites.

16. Disclaimers

To the fullest extent permitted by law, the Site and our products are provided on an “as is” and “as available” basis. Except for warranties that cannot be excluded under applicable consumer protection law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that defects will be corrected. Information on the Site (including ingredient descriptions and educational content) is provided for general information only and is not a substitute for professional medical, dermatological, or other advice.

17. Limitation of liability

To the fullest extent permitted by law, Velura Hair, its directors, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Site or our products, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to the Site or any product, whether in contract, tort (including negligence), strict liability, or otherwise, is limited to the greater of (a) the amount you paid to us for the product giving rise to the claim in the 12 months preceding the event, or (b) CAD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for fraud, fraudulent misrepresentation, or for death or personal injury caused by negligence.

18. Indemnification

You agree to indemnify and hold harmless Velura Hair and its directors, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms; (b) your User Content; (c) your violation of any law or third-party right; or (d) your misuse of any Velura product.

19. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.

You and Velura agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, for the resolution of any dispute, except that we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or the security of the Site.

Nothing in this Section limits any non-waivable right you have to bring proceedings in the courts of your home province under applicable consumer protection legislation.

20. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

21. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, fire, flood, earthquake, pandemic, labour disruption, supplier failure, carrier delay, telecommunications outage, or government action.

22. Changes to these Terms

We may update these Terms from time to time. The “Effective date” at the top reflects the latest version. Material changes will be brought to your attention through a notice on the Site or, where appropriate, by email. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. If you do not agree, please stop using the Site.

23. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any order confirmation, constitute the entire agreement between you and Velura regarding the Site and your purchases.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of all or part of our business.
Headings. Section headings are for convenience only and do not affect interpretation.
Language. The parties have requested that these Terms be drafted in English. Les parties ont demandé que ces conditions soient rédigées en anglais.
